Uncollected Shipments
Failure to collect or accept a shipment does not in itself constitute withdrawal from the contract. To exercise the statutory right of withdrawal, the customer must notify Tactical Supply® of the decision to withdraw by an unequivocal statement.
Uncollected or refused shipments returned to Tactical Supply® are not automatically refunded or reshipped. The customer is responsible for contacting Tactical Supply® regarding any further handling of the returned shipment.
If a shipment is returned to Tactical Supply® because the customer failed to collect or accept it, refused delivery, or provided incorrect or incomplete delivery information, the customer shall bear the actual and reasonable direct costs resulting from the failed delivery and return of the shipment, to the extent permitted by applicable law. Any reshipment is subject to payment of the applicable delivery costs and any outstanding costs arising from the failed delivery.
Where the customer validly exercises a statutory right of withdrawal, reimbursement will be made in accordance with the applicable statutory withdrawal rules.
Right of withdrawal
A consumer has the right to withdraw from a distance sales contract within 14 days without giving any reason. The withdrawal period generally begins on the day on which the consumer, or a third party designated by the consumer other than the carrier, receives the goods. The statutory right of withdrawal does not apply to purchasers who are legal persons.
To exercise the right of withdrawal, the customer must notify Tactical Supply® of the decision to withdraw by an unequivocal statement sent to returns@tacticalsupply.eu before the withdrawal period expires.
The customer must return the goods without undue delay and no later than 14 days after notifying Tactical Supply® of the withdrawal.
Tactical Supply® offers free returns from Estonia. For returns from other countries, the customer bears the direct cost of returning the goods, unless otherwise required by applicable law. Claims concerning defective, incorrect or otherwise non-conforming goods are governed separately by the rules applicable to defective goods.
The customer may inspect and handle the goods only to the extent necessary to establish their nature, characteristics and functioning, in the same manner as would reasonably be permitted in a physical store. The customer is liable for any diminished value resulting from handling beyond what is necessary for this purpose. Where applicable, Tactical Supply® may deduct the amount corresponding to such diminished value from the refund.
In the event of a valid withdrawal, Tactical Supply® will reimburse the payments received under the contract, including the cost of the least expensive standard delivery method offered by Tactical Supply®, no later than 14 days after being informed of the customer’s decision to withdraw. If the customer selected a more expensive delivery method, Tactical Supply® is not required to reimburse the additional cost exceeding the cost of the least expensive standard delivery method offered.
Tactical Supply® may withhold reimbursement until the returned goods have been received or until the customer has provided evidence that the goods have been returned, whichever occurs first.
The statutory right of withdrawal is subject to the exceptions provided by applicable law.
